.SHIMLA: High Court of HimachalPradesh today rejected the bail of the six minth Drug accused undertrial.
The judge Sandeep Sharma observed circumstances are peculiar to the accused, and the larger interests of society.
In the case at hand, while the presumption of innocence until proven guilty remains paramount, the court must also consider the potential risk posed to society, especially given the repeated involvement of the petitioner in alleged drug trafficking activities, as evidenced by multiple prior cases under the NDPS Act.
The court, therefore, finds it inappropriate to grant bail at this stage, primarily due to the accused's alleged role within a broader network facilitating drug distribution and the gravity of the societal harm caused by such offenses. In weighing these factors against the petitioner's six-month detention period, the court concludes that the interests of public safety and effective law enforcement outweigh the immediate release of the petitioner.
In light of the above reasoning, the bail petition is denied.
The trial court is, however, directed to expedite the proceedings to ensure that the trial progresses without undue delay, safeguarding the petitioner’s right to a fair and timely process.
