Shimla, November 21, 2024:  Himachal Pradesh High Court has issued directives to expedite action against the production of spurious and sub-standard drugs in the state’s pharmaceutical hub of Baddi.

The court was hearing a petition filed by Themis Medicare Limited, which alleged inaction despite repeated complaints about the manufacture of non-compliant drugs that pose serious risks to public health.

The matter was heard by Hon’ble Justice Sandeep Sharma, who observed that the issue raised in the petition warranted immediate attention.

The petitioner, represented by Senior Advocate Mr. N.K. Sood, assisted by Advocate Ms. Shradha Karol, pointed out specific allegations regarding the manufacture of medicines like Feracrylum API and 1% Feracrylum Gel, claiming these did not meet prescribed standards and formulas.

Acknowledging the gravity of the allegations, the court refrained from delving into the merits of the case but emphasized the urgency of addressing the complaint.

Justice Sharma directed the State Drugs Controller (respondent No. 1) to resolve the pending complaint, dated March 15, 2024, within two weeks. He also stressed that due process be followed by providing all stakeholders, including the petitioner, an opportunity to present their case.

During the proceedings, Additional Advocate General Mr. Rajan Kahol assured the court that appropriate action would be taken without delay.

The court clarified that the petitioner could seek further legal remedies if unsatisfied with the response from the authorities.

The case highlights the pressing need for stringent oversight in Baddi, a hub of pharmaceutical production, to ensure the safety and efficacy of drugs reaching the public.

The High Court’s firm stance sends a strong message to regulators and manufacturers alike to uphold the highest standards of public health.
