High Court of Himachal Pradesh Overturns University Decision, Orders Promotion
SHIMLA: In a ruling, the High Court of Himachal Pradesh has overturned a decision by HP Krishi Vishwavidyalaya Palampur regarding the promotion of a Superintendent Grade Two.
The Division Bench of Justices Tarlok Singh Chauhan and Sushil Kukreja, declared the university's action as illegal, citing a misinterpretation of the model code of conduct.
The petitioner, whose promotion had been denied by the university, challenged the decision, asserting their rightful claim to the position.
The court concurred, emphasizing that the denial lacked any financial basis and was grounded in a flawed understanding of the model code of conduct.
In its verdict, the High Court ordered the quashing of the university's decision and directed the immediate promotion of the petitioner to the Superintendent Grade Two position, effective from November 1, 2017.
Additionally, the court called upon the Chief Secretary to the Government of Himachal Pradesh to issue clear guidelines regarding the interpretation and application of the model code of conduct.
The ruling serves as a reminder to government institutions about the importance of adhering to legal procedures and ensuring fairness in administrative decisions. Compliance with the court's directive is expected by May 6th, 2024.
