Shimla, Sept 16 – The Himachal Pradesh High Court has directed the state government to allow an Ayurvedic Medical Officer, Dr. Divyanshu, to complete her MD in Dravyaguna Vigyana at Chaudhary Brahm Prakash Ayurved Charak Sansthan, New Delhi.
Justice Sandeep Sharma observed that the state acted arbitrarily by denying her the same benefit of extension in joining time that was granted to 14 other similarly placed candidates. The court noted that while Dr. Divyanshu joined service on June 10, 2024, to avoid cancellation of her appointment, the Department of Ayush granted extension to others just a day later, enabling them to complete their postgraduate courses.
The court quashed government communications dated February 15 and 21, 2025, and directed the state to grant her extension in joining time within two weeks, at par with other candidates.
Justice Sharma remarked that denying her parity despite being in the same situation was “unjustified and discriminatory,” adding that even her signed contract automatically stood cancelled once the government issued its extension order.
