High Court of Himachal Pradesh Upholds 10-Year Sentence for Narcotics Offence... 

Shimla — In a ruling, the High Court of Himachal Pradesh has upheld the conviction and sentencing of Sanjay Tomar for his involvement in narcotics distribution.

 The decision, reserved on April 25, 2024, and announced today, was delivered by a bench comprising Hon’ble Mr. Justice Vivek Singh Thakur and Hon’ble Mr. Justice Rakesh Kainthla.

Tomar was originally convicted by the Special Judge in Chamba on December 31, 2019, under Section 21 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

He was sentenced to 10 years of rigorous imprisonment and fined ₹1,00,000. In default of payment, he would face an additional year of simple imprisonment. The High Court's ruling confirms both the conviction and the sentence.

The case against Tomar stemmed from a police operation on March 5, 2018. HC-Virender Singh (PW11) of the Special Investigating Unit (SIU) received a tip-off about Tomar's activities.

According to the prosecution, Tomar had rented a room from Sourav Boss (PW1) in Udaipur and was allegedly selling injections and capsules containing psychotropic substances to students.

The defense, represented by Mr. Hemant Kumar, argued against the conviction, while Mr. Varun Chandel, Additional Advocate General, defended the state’s case.

The High Court, in its detailed judgment, found no merit in the appeal and upheld the trial court's decision.

This ruling is seen as a stern warning against narcotics trafficking in the region and underscores the judiciary's commitment to combating drug-related crimes.
