Strict Warnings Issued to Chief Secretary Himachal Pradesh..
Shimla – The Himachal Pradesh High Court has ordered a major crackdown on encroachments along National Highway-5 (NH-5).
The court took strict action against unauthorized constructions and road obstructions.
This directive comes from a public interest litigation (PIL) filed in 2014. Rising concerns over encroachments, which caused traffic issues and trouble for citizens, brought this case to light.
Judicial Stand Against Encroachments A division bench led by Justice Vivek Singh Thakur and Justice Rakesh Kainthla voiced frustration over the ongoing obstructions.
Unauthorized parking and road hindrances on NH-5 have worsened the situation.
The court took up the PIL on its own motion, demanding answers from various government bodies and officials.
Who’s Accountable? Senior Advocate J.L. Bhardwaj, serving as amicus curiae, presented affidavits from state authorities detailing action plans.
The Municipal Corporation of Shimla is now actively detecting illegal constructions. Authorities in Solan have flagged 27 cases in the Shimla-Kalka, Barog, and Kasauli planning areas.
Special Area Development Authorities (SADA) in Jabli and other regions have identified 11 more cases. Violators are facing disconnection of water and electricity supplies.
What’s Next? The court’s order is firm. All cases must be resolved by March 31, 2025. No new unauthorized constructions or encroachments will be allowed.
The Chief Secretary has been directed to issue strict orders to all local bodies, from revenue officers to panchayats, to maintain strict vigilance.
Officials found neglecting their duties will face severe consequences.
These may include contempt proceedings, departmental action, and even criminal charges.
The Chief Secretary is to ensure clear, unwavering guidelines reach all state areas.
The scope includes highways, state roads, and district roads, to prevent further cases.
Acknowledging Efforts The High Court praised the dedicated work of Senior Advocate Bhardwaj as amicus curiae. His efforts were instrumental in pushing the matter forward.
The PIL stands closed, but the court emphasized it will remain watchful. Any sign of negligence won’t be tolerated.
