HP High Court Puts Brake on Full Demolition, Allows Only Upper Floors to Go in Sanjauli Mosque Case
Shimla, December 4:
The Himachal Pradesh High Court on Thursday delivered a fresh twist in the long-running Sanjauli mosque dispute allowing demolition of the top three floors of the five storey structure but putting a status quo shield over the ground and first floors.
The court made it clear the upper floors were purely unauthorised and must be removed as per earlier municipal and district court orders.
However any action on the bottom two floors has been frozen till the next hearing giving temporary relief to the Waqf Board and the mosque committee
The Waqf Board informed the court that two illegal upper floors have already been demolished and the third will be removed soon.
The Bench has now sought replies from the Shimla Municipal Corporation and other parties and fixed the matter for March 9, 2026.
The case has been on boil since locals including Sangharsh Samiti raised objections over construction without mandatory approvals.
Over the past year the SMC Commissioner and the District Court had declared the entire building unauthorised and ordered full demolition.
The High Court’s latest order stops short of that allowing only partial demolition for now.
VHP leader VP Singh says the Sangharsh Samiti welcomes the decision of the High Court, attributed it to the whole struggle of united Hindu samaaj. They will chart next course of action soon, he added.
