The state election commission has filed special leave petition(SLP) in the Supreme court against the High court order seeking vacation of stay on the elections of the Shimla Municipal corporation.
Supreme court today listed the special leave petitions for 29.09.2022. The case was listed in the bench of Chief Justice of India today.
Chief Justice of India ruled that the SLPs have been listed for 29.09.2022 and hearing was adjourned for two weeks.
Supreme Court meantime has asked the High Court of Himachal Pradesh to consider taking up the matter as early as possible in accordance with law.
The counsel appearing for the petitioners, state election commission submitted that in terms of the orders which are presently under challenge, the matter had appeared before High Court on 16.08.22, but at the request of the state Advocate General the matter was adjourned for two weeks.
As a result of this legal battle, the elections to the new body of the Shimla Municipal Corporation which had been due since June 20, 2022, are set to be delayed till the Supreme Court disposes of the Special Leave Petitions(SLPs).
The state election Commission has filed the cast against the Congress councilors, Simi and others for vacation of stay passed by the High Court of Himachal Pradesh.
As a matter of the fact High court of Himachal Pradesh had passed the order on 21st July, 2022 on the petition of Simi Nanda who had challenged delimitation of wards.
